Spousal support isn't part of a divorce automatically. It is at the discretion of the court, which will analyze several factors, including:

  • Income of both spouses
  • The earning capacity of each spouse
  • Duration of marriage
  • Health & age of both parties
  • Whether child support also needs to be paid

Each case is decided on its circumstances. Hire an experienced family law attorney to know whether you are eligible to receive or have to pay spousal support.

The court will follow the best interests of the child standard when deciding custody. It will assess several factors like the age and emotional needs of the child, the relationship shared by the child with each parent, each parent's ability to care for the child, and whether there's a history of domestic violence or substance abuse by either parent.

The court will prefer a joint custody arrangement so both parents have continuous and frequent involvement in the child's upbringing. But if such an arrangement contradicts the best interests of the child, the court may order sole custody with one parent and give visitation rights to the other.

It is important to remember that even if you are a custodial parent, the non-custodial parent also has rights. If you wish to relocate, you must obtain the consent of the non-custodial parent first.

It's best to create an agreement that satisfies both parties (such as the child spending time with the other parent during summer vacations). If an agreement cannot be reached, then a motion for relocation must be filed in court. The court will determine if such a relocation is in the best interests of the child and render a judgment accordingly.

The court has the power to order access to attorney's fees to ensure both parties are legally represented. If you cannot afford to hire an attorney, you have to submit the form FL-300 to request access to attorney's fees. The court will analyze various factors and grant access to attorney's fees if the conditions are met.

If you and your spouse cannot cooperate or do not communicate well, divorce litigation may be the only option left.
