Our Divorce Services

In Orange County, no two divorces are the same. Here are some specialized divorce services our Arabic divorce lawyers OC handle:

Mahr and Islamic Marriage Contracts

We have the legal expertise necessary to handle the intersection of California’s Divorce Laws with Arabic marriage practices. Thus, if you are seeking to contest or enforce a “Mahr”, we will stand with you until the end to get more than the outcome you are hoping for.

Contested and Uncontested Dissolution

Whether you are seeking a discreet, amiable dissolution of your marriage through an uncontested divorce or want to go the traditional route of a trial where the court shall intervene on major issues like asset division, child custody, child support, and visitation, we will be with you every step of the way.

Legal Custody

As a parent/guardian with legal custody, you will make important decisions concerning your child’s life, such as those related to their education, healthcare, extracurricular activities, and community involvement, among others. Whether you get sole or shared custody, our Arabic divorce lawyer OC can help decide in your favor.

Physical Custody

Usually the court decides which parent the child will physically reside with. Physical custody can be sole, where the primary caregiver usually gets custody of the child, or it can be shared. In shared custody, both parents get equitable time with the child or one parent gets visitation rights on weekends and holidays.

Spousal Support & Alimony

Our highly seasoned divorce lawyers who speak Arabic can help contest or enforce alimony if the Court deems you worthy of it. Alimony is a legal instrument that restores parity between partners, especially if one of the partners missed career opportunities because they were involved in supporting the other’s career & education.

Asset & Property Division

California operates under a community property system, which mandates that all assets and debts acquired during a marriage belong equally to both spouses. While the "50/50" rule sounds straightforward, the path to an equitable distribution is often fraught with complexity—particularly when high-value assets are involved.

Mediation & Alternative Dispute Resolution

Avoid the stress of litigation with alternative dispute resolution. Mediation uses a neutral third party to foster cooperation, while private arbitration or attorney-led negotiations can expedite your case outside the courtroom. These paths offer more control and privacy than traditional court-mandated decrees.

The Divorce Process in Orange County

Let us walk you through the divorce process step-by-step so that you know what to expect and can brace yourself better.

1

Filing The Divorce Petition

In California, the divorce proceedings begin when one party files for divorce, and the respondent has 30 days within which to file a response.

Herein, your attorney may file a request for a show cause hearing, where a judge may proclaim a temporary child custody order, child support orders or restraining orders.

2

The Discovery Phase

Both sides share documents and information in this step. Your Arabic divorce lawyer OC can help prepare a Preliminary Declaration of Disclosure, which includes information on assets, income, and expenses.

Your Arabic speaking lawyer will also help you prepare a Marital Settlement Agreement, which will detail other related matters such as spousal support, child support, child custody, and division of assets.

3

The Dissolution of Marriage

As the final step of the divorce proceeding, the judge issues a Judgment of Dissolution of Marriage which details all the court orders. After this, the divorce is finalized within 6 months.

Thank you very much to Mr. Jos and to all his group of professionals who helped me get out of my child support case with a very good result. Each case is different and my case was very complicated. I live in the state of Virginia and the child support office of the state of California was starting a case against me, the amount they wanted me to pay was ridiculously high I didn't know what to do because I don't live in California and I had never met the child either. I searched online for a lawyer in California and thank God I found Mr. Jos's law office. I don't know them personally but I put my trust in them and they didn't disappoint me. We had very good communication despite the distance and they were always available to talk to me and clarify my doubts. Mr. James was the one who took my case to the end and after a long and very difficult process everything went very well in my favor much more than expected. I am very grateful to God for putting the entire team of professionals from Mr. Jos' office on my way. Words are not enough for me to describe everything they did for me and how grateful I am. I definitely recommend Mr. Jos's law firm. Thank you Mr. James for not giving up in my case and having achieved a magnificent result in my favor.

This was the second attorney that represented me for my divorce. Binoye is a very knowledgeable, fair, and professional attorney. They are reliable and this made my experience way less painful. They are definitely not greedy for money, they are not one of the many attorneys out there who overbill for their services. I truly recommend them.

JOS family Law took on my case which entailed custody and move away components and I honestly could not say enough great things about JOS Family Law! Mr. Jos is not only extremely knowledgeable and professional, but it is also extremely obvious how much he cares for his clients on a personal level as well. There is an expression that two heads are better than one, however, Mr. Jos' philosophy takes it further as eight heads are better than two. It was so impressive and reassuring how collaborative everyone at the office works together to meet on regular cadences and discuss their client's cases to brainstorm strategies in order to seek the best possible outcome for their clients. Mr. Jos has an amazing team of extremely talented and knowledgeable attorneys that have worked together on my case. James was the lead attorney on my case and also represented me in my hearing. James was able to get us everything we were asking for as he successfully proved that full custody remaining with me is in the best interest of the children and that the move away is in the best interest of the children as well. We were able to come up with a plan to ensure that the children's mother can visit regularly and still maintain a healthy relationship. James is a rock star attorney! I would without hesitation refer anyone seeking help in a family law matter to call Jos Family Law!

Frequently Asked Questions

No two divorces are alike. Simple divorces involving short marriages, minimal assets, no children, and full agreement between spouses may qualify for summary dissolution and be finalized in about six months. More complex divorces involving long marriages, children, or major assets may take over a year. California requires a six-month waiting period before a divorce becomes final.

California is a no-fault divorce state, meaning both spouses do not need to agree to the divorce. The court only needs to determine that irreconcilable differences caused the breakdown of the marriage.

Both legal separation and divorce involve dividing assets, determining custody, and living separately. However, legal separation does not end the marriage. Couples may retain certain benefits like tax or health insurance coverage, but they cannot remarry unless they later obtain a divorce.

At least one spouse must have lived in California for six months and in the filing county for at least three months before filing for divorce.

While it is technically possible to handle divorce proceedings without a lawyer, it is not recommended. Divorce involves legal, financial, and custody considerations that can have long-term consequences. Hiring an experienced divorce attorney helps protect your interests.
