What are California’s Custody Terms?

The state of California recognizes legal and physical custody as the two main types of custody. Apart from these, visitation laws may also apply to the non-custodial parent under certain circumstances.

Physical Custody Refers to which parent the child will share residence with and how their time will be distributed between both parents. Physical custody can be of two types

  • Sole: The child lives with one parent for the majority of their time while the other parent is granted visitation or supervised visitation
  • Joint: Both parents get equal parenting time each week or for a set duration. The schedule each parent shares with the child is roughly equal.

Legal Custody: This refers to a parent’s rights to make important decisions about the child’s upbringing related to their education, healthcare, religious influence, and other activities they may be involved in. In many cases, parents have joint legal custody where the non-custodial parent is granted equal rights in making decisions about the child’s future.

Visitation: This is awarded to the non-custodial parent, ensuring that they have a healthy, consistent relationship with the child after the divorce or separation. It can be of four main types:

  • Scheduled: The court decides specific dates and times which the child will spend with the visiting parent. Scheduled visits can include holidays, vacations, and other important events related to the family, such as birthdays, mothers’ day, fathers’ day, etc.
  • Reasonable: These visits are worked out by mutual agreement of a schedule between both parents. However, if no mutual agreement can be reached, then court-directed scheduled visits are encouraged
  • Supervised: If one of the parents displays signs of harming the safety and well being of the child, then they may be granted visits supervised by the other parent, adult, or a professional agency. Supervised visits are also encouraged for parents who were absent from the child’s life for a long time and would now like the child to become familiar with them.
  • None: A non-custodial parent may be denied visitation if they are found to be harmful for the child even in a supervised visitation arrangement.
